Bruss Legal PLLC wants you to be familiar with how we collect, use and disclose information. This Privacy Policy describes our practices in connection with information that we collect online and offline, through our websites ("Websites"), through social media properties ("Our Social Media") from which you are accessing this Privacy Policy, through services we provide to our clients ("Client Services"), and through any other offline business interactions you may have with us ("Offline Interactions").
COLLECTION OF PERSONAL INFORMATION
Collectively, we refer to the Websites, Our Social Media, Client Services and Offline Interactions as the "Services."
"Personal Information" is information that identifies you as an individual or relates to an identifiable individual. Different pieces of information, which collected together can lead to the identification of a particular person, also constitute personal information. These include name, address (including personal, business, billing and shipping addresses), telephone number, email address (personal and business), and job title and employer.
We and our service providers collect Personal Information in a variety of ways, including through the Services, for example when you sign up for a newsletter, request Services, register for a webinar or course, participate in a contractual arrangement for Client Services, provide information in conjunction with our Client Services, or when you interact with us at an event, call or email our offices, or visit our office. We also receive Personal Information from other sources, including publicly available databases, joint marketing partners and event sponsors when they share information with us, entities to which we provide Client Services, which may include your employer, and social media platforms.
We need to collect Personal Information in order to provide the requested Services to you. If you do not provide the information requested, we may not be able to provide the Services. If you disclose any Personal Information relating to other people to us or to our service providers in connection with the Services, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.
USE OF PERSONAL INFORMATION
We and our service providers use Personal Information for legitimate business purposes, including providing the functionality of the Services and fulfilling your requests, responding to your inquiries, sending administrative information to you, providing you with our newsletter and other marketing materials with your consent or where we have a legitimate interest, aggregating and anonymizing Personal Information, accomplishing our business purposes such as data analysis, audits, fraud and security monitoring, and meeting our legal and regulatory obligations, and providing Client Services, including validating authorized signatories, contacting individuals in connection with providing Client Services, and administering client files.
DISCLOSURE OF PERSONAL INFORMATION
We disclose Personal Information to our third party service providers to facilitate services they provide to us, including website hosting, consulting and monitoring, data analysis, information technology, customer service, email delivery, and auditing. We may disclose Personal Information to outside counsel with whom we may consult to perform Services on your behalf. By using the Services, you may elect to disclose Personal Information on message boards, chat, profile pages, blogs and other services to which you are able to post information, including Our Social Media. Any information you post or disclose through these services will become public.
We also use and disclose Personal Information as necessary or appropriate to comply with applicable law and regulations, to cooperate with public, government, and law enforcement authorities, to enforce our terms and conditions, to protect our rights, privacy, safety or property, and in connection with a sale, merger, or other business transaction.
OTHER INFORMATION
"Other Information" is any information that does not reveal your specific identity or directly relate to an identifiable individual, including browser and device information, app usage data, information collected through cookies, pixel tags and similar technologies, and demographic information. If we are required to treat Other Information as Personal Information under applicable law, we will use and disclose it accordingly.
We and our service providers collect Other Information through your browser or device, using cookies, pixel tags and similar technologies, and through analytics tools including Google Analytics. We honor recognized opt-out preference signals, including the Global Privacy Control (GPC), where required by applicable state law. Your IP address is automatically collected in our server log files whenever you access the Services, and we may derive your approximate location from it. We may use and disclose Other Information for any purpose except where applicable law requires otherwise. If we combine Other Information with Personal Information, we treat the combined information as Personal Information for as long as it is combined.
SECURITY
We seek to use reasonable organizational, technical and administrative measures to protect Personal Information within our organization. No data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us in accordance with the "Contacting Us" section below.
YOUR PRIVACY CHOICES
If you no longer want to receive marketing related emails from us, you may opt out by following the unsubscribe instructions in any such message or by contacting us at amanda@brusslegal.com. We may still send you important administrative messages, from which you cannot opt out.
Depending on your state of residence, you may have additional rights to access, correct, delete, or limit our use of your Personal Information, and to opt out of certain processing such as targeted advertising or the sale of Personal Information. These rights, and how to exercise them, are described in the state specific sections below. Where required by applicable law, we honor opt-out preference signals such as the Global Privacy Control as a valid method of exercising your opt-out rights.
To request to review, correct, update, suppress or delete, or object to or restrict processing of Personal Information you have previously provided to us, or to request an electronic copy of your Personal Information, please contact us. We will respond consistent with applicable law, and we may need to verify your identity before implementing your request.
RETENTION PERIOD
We retain Personal Information for as long as needed or permitted in light of the purpose for which it was obtained and consistent with applicable law, based on the length of our relationship with you, any legal obligation requiring us to keep records for a certain period, and whether retention is legally advisable, such as in regard to applicable statutes of limitations, litigation, or regulatory investigations.
THIRD PARTY SERVICES
This Privacy Policy does not address, and we are not responsible for, the privacy or other practices of any third parties, including any third party operating a website or service to which the Services link. We are not responsible for the information practices of other organizations, such as Facebook, Apple, Google, Microsoft, or any other app developer, platform provider, or device manufacturer.
USE OF SERVICES BY MINORS
The Services are not directed to individuals under the age of eighteen, and we do not knowingly collect Personal Information from individuals under 18. Certain states, including Colorado and New Jersey, provide additional protections for the personal data of minors, including limits on the use of such data for targeted advertising, sale, and profiling. We do not knowingly engage in such practices with respect to minors’ data.
CROSS BORDER TRANSFER
Your Personal Information may be stored and processed in any country where we engage service providers. By using the Services, you understand that your information will be transferred to countries outside your country of residence, including the United States, which may have different data protection rules. Courts, law enforcement, or regulatory authorities in those countries may be entitled to access your Personal Information.
SENSITIVE INFORMATION
We ask that you not send us, and you not disclose, any sensitive Personal Information on or through the Services or otherwise to us. This includes, for example, Social Security numbers, information related to racial or ethnic origin, immigration or citizenship status, political opinions, religion or other beliefs, health conditions, sexual orientation or gender identity, biometric, genetic, or neural data, precise geolocation, criminal background, trade union membership, or financial account or payment card numbers in combination with any required security or access code.

You may lodge a complaint with a data protection authority for your country or region, or where an alleged infringement of applicable data protection law occurs. ADDITIONAL INFORMATION REGARDING CALIFORNIA
The rights described in this Section apply to California residents to the extent Bruss Legal PLLC meets the applicability thresholds of the California Consumer Privacy Act, as amended by the California Privacy Rights Act and its implementing regulations (together, the "CCPA").
Sources of Personal Information.
As described above, we collect Personal Information from you, publicly available databases, social media platforms, and joint marketing partners and event sponsors.
Categories of Personal Information Collected and Disclosed.
The categories of Personal Information about California residents we collect and have disclosed to service providers and vendors for our operational business purposes in the preceding 12 months include identifiers such as name, postal address, online or device identifier, IP address, and email address, personal information as defined in the California customer records law, characteristics of protected classifications under California or federal law which we may collect to provide Client Services, commercial information such as Client Services transaction history and payment information, internet or electronic network activity information, geolocation data, audio, electronic, visual and similar information, and professional or employment related information.
Automated Decision Making Technology.
Bruss Legal PLLC does not currently use automated decision making technology to make significant decisions about California residents. If this changes, we will provide notice consistent with CCPA requirements, including any applicable right to access information about and opt out of such use.
Use of Personal Information.
We may use this Personal Information to operate, manage, and maintain our business, provide our services, personalize and market our services, conduct research and analytics, comply with law, maintain records, facilitate corporate transactions, and exercise and defend legal claims. We do not "sell" and have not "sold" Personal Information in the preceding 12 months for purposes of the CCPA.
Individual Rights and Requests.
If you are a California resident, you may request that we disclose the categories and specific pieces of Personal Information we collected about you, the sources of that information, the business purpose for collecting it, and the categories of third parties with whom it was shared, generally covering information collected since January 1, 2022, unless doing so is impossible or would involve disproportionate effort. You may also request that we correct inaccurate Personal Information, delete Personal Information we collected from you, limit our use and disclosure of sensitive Personal Information, and, if applicable, opt out of the sale or sharing of your Personal Information. You have the right to appeal a denial of any request, and the right to be free from unlawful discrimination for exercising your rights under the CCPA.

We honor opt-out preference signals, including the Global Privacy Control, as a valid method of submitting a request to opt out of sale or sharing. We will verify and respond to your request consistent with applicable law, and we may need to request additional information to verify your identity or your status as an authorized agent.
California “Shine the Light” Disclosures.
We may disclose Personal Information to affiliates of Bruss Legal PLLC, which may use this information for all purposes outlined in this Privacy Policy. If you would like to learn more or make a request to discontinue this type of sharing, please email us at amanda@brusslegal.com or contact us by mail at the address above. We will provide a list of the categories of Personal Information disclosed to affiliates for their direct marketing purposes during the immediately preceding calendar year, along with their names and addresses, upon request made no more than once per calendar year.
ADDITIONAL INFORMATION REGARDING COLORADO
Bruss Legal PLLC is headquartered in Colorado. The rights described in this Section apply to Colorado residents to the extent Bruss Legal PLLC meets the applicability thresholds of the Colorado Privacy Act (the "CPA").
If the CPA applies to us, Colorado residents have the right to access, correct, and delete their Personal Information, the right to data portability, the right to opt out of the processing of Personal Information for purposes of targeted advertising, the sale of Personal Information, or profiling in furtherance of decisions that produce legal or similarly significant effects, and the right to opt in before we process sensitive Personal Information.
To exercise these rights, please contact us using the information in the Contacting Us section above. We will respond within 45 days. If we decline to take action on your request, you may appeal our decision by contacting us at amanda@brusslegal.com. If your appeal is denied, you may contact the Colorado Attorney General. We honor universal opt-out mechanisms, including the Global Privacy Control, as a valid method of opting out of the sale of Personal Information and targeted advertising.
ADDITIONAL INFORMATION REGARDING NEW JERSEY
The rights described in this Section apply to New Jersey residents to the extent Bruss Legal PLLC meets the applicability thresholds of the New Jersey Data Privacy Act (the "NJDPA").
If the NJDPA applies to us, New Jersey residents have the right to confirm whether we are processing their Personal Information, to access, correct, and delete their Personal Information, the right to data portability, the right to opt out of the processing of Personal Information for purposes of targeted advertising, the sale of Personal Information, or profiling in furtherance of decisions that produce legal or similarly significant effects, and the right to opt in before we process sensitive Personal Information.
To exercise these rights, please contact us using the information in the Contacting Us section above. We will respond within 45 days, with a possible 45 day extension where reasonably necessary. If we decline to take action on your request, you may appeal our decision by contacting us at amanda@brusslegal.com. If your appeal is denied, you may contact the New Jersey Division of Consumer Affairs. We honor universal opt-out mechanisms, including the Global Privacy Control, as a valid method of opting out of the sale of Personal Information and targeted advertising.
New Jersey law separately prohibits the sale of sensitive Personal Information, regardless of a business’s size or data processing volume. Bruss Legal PLLC does not sell sensitive Personal Information.
COOKIE POLICY
Cookies are a standard feature of websites that allow us to store small amounts of data on your computer about your visit to the Site. Cookies help us learn which areas of the Site are useful and which need improvement. We also use similar technologies such as pixel tags. You can choose whether to accept various categories of cookies, though disabling cookies may diminish your experience on the Site.
